What This Means (2025 FDD)
According to Beard Papas's 2025 Franchise Disclosure Document, a Site Selection Acknowledgment is indeed included as Exhibit 3 to the Franchise Agreement. The Site Selection Acknowledgment does not grant or designate a designated territory and does not grant any territorial rights.
The Site Selection Acknowledgment form includes a space for the franchisor to specify the Site Selection Area. The franchisor must complete the Site Selection Acknowledgment Date and sign the acknowledgment for it to be effective. If the franchisor does not complete and sign the acknowledgment, it will not be effective, and there will be no Site Selection Area.
The Site Selection Period commences on the Site Selection Acknowledgment Date and automatically expires 60 calendar days after that date. If the Site Selection Acknowledgment Date is not set forth by the franchisor in the Site Selection Acknowledgment, the Site Selection Period will be zero days. If the Site Selection Acknowledgment is not signed by the franchisor, there will be no Site Selection Period.
