-"Operating Manager" refers to and means the Manager designated by Franchisee or Franchisee's Managing Owner, that is charged with the obligation and responsibility to supervise and manage (onsite at Franchisee's Shop Facility) the day-to-day operations of the Franchised Business.
At all times, the Operating Manager must: (a) meet all of Franchisor's minimum training and brand quality control standards and criteria for managers as may be set forth in the Operations Manual; (b) successfully complete Franchisor's initial training program; (c) sign the Confidentiality Agreement; and (d) agree, in writing, to assume responsibility for the on-site management and supervision of the Franchised Business.
If the Operating Manager is a family member of Franchisee and/or an Owner then the Operating Manager must also sign and agree to be bound by the terms of the Owner and Spouse Agreement and Guaranty.
- (3) If, at any time, the Franchised Business is not being managed by a Managing Owner or Operating Manager who satisfactorily completed the Training Program, Franchisor is authorized, but is not required, to immediately appoint a manager to maintain the operations of the Franchised Business for and on behalf of Franchisee.
Franchisor's appointment of a manager of the Franchised Business does not relieve Franchisee of its obligations or constitute a waiver of Franchisor's right to terminate the Franchise pursuant to Article 16.

According to Beard Papas's 2025 Franchise Disclosure Document, the Operating Manager is responsible for the day-to-day operations of the franchised business at the shop facility. The Operating Manager must supervise and manage the business on-site.
To qualify, the Operating Manager must meet Beard Papas's minimum training and brand quality control standards, as detailed in the Operations Manual. They are also required to successfully complete the initial training program provided by Beard Papas. This ensures that the manager is well-versed in the brand's standards and operational procedures.
Additionally, the Operating Manager must sign a Confidentiality Agreement, committing to protect the sensitive information related to the Beard Papas business. They must also agree in writing to take responsibility for the on-site management and supervision of the franchised business. If the Operating Manager is a family member of the franchisee or an owner, they must also sign and agree to be bound by the terms of the Owner and Spouse Agreement and Guaranty.
If a Beard Papas shop is not being managed by a Managing Owner or Operating Manager who has satisfactorily completed the Training Program, Beard Papas is authorized to appoint a manager to maintain operations on behalf of the franchisee. However, this does not relieve the franchisee of their obligations or waive Beard Papa's right to terminate the franchise agreement.
