Franchisee agrees that what constitutes Franchisor's then current Franchise Agreement shall be determined by Franchisor, in Franchisor's exclusive discretion and that, among other things, the Franchise Agreement may be modified from time to time by Franchisor and that reasonable modification and amendments to the Franchise Agreement will not alter Franchisee's obligations under this Agreement.

What This Means (2025 FDD)
According to the 2025 Beard Papas Franchise Disclosure Document, the franchisor has the authority to modify the franchise agreement. The FDD states that Beard Papas determines what constitutes the current Franchise Agreement in its exclusive discretion.
Beard Papas may modify the Franchise Agreement from time to time. Reasonable modifications and amendments to the Franchise Agreement will not alter the franchisee's obligations under the agreement.
This means that as a potential franchisee, you should be aware that the terms of your franchise agreement could change during the term of the agreement. While the modifications are expected to be reasonable, Beard Papas retains the right to make these changes.
