Franchisee shall keep and maintain the confidentiality of the Operations Manual and, shall keep and maintain all files, data and information contained in the Operations Manual in a secure location and/or in a protected confidential state and, as otherwise directed by Franchisor.

According to the 2025 Beard Papas FDD, a franchisee must keep and maintain all files, data, and information contained in the Operations Manual in a secure location and/or in a protected confidential state, as directed by Beard Papas. This obligation extends both during the term of the Franchise Agreement and after its expiration or termination. Franchisees must also refrain from making unauthorized copies of any documents containing the Know-How. Franchisees must take all reasonable steps required by Beard Papas to prevent unauthorized use or disclosure. Upon termination of the agreement, the Operations Manual and all copies must be returned to Beard Papas.
