What This Means (2025 FDD)
According to the 2025 Beard Papas Franchise Disclosure Document, the franchisee is subject to modifications and amendments to the Franchise Agreement. The FDD states that what constitutes the current Franchise Agreement is determined by Beard Papas in its exclusive discretion. Reasonable modifications and amendments to the Franchise Agreement will not alter the franchisee's obligations under the agreement.
This means that Beard Papas has the right to change the terms of the Franchise Agreement over time, and franchisees are still obligated to comply with the updated terms. While the modifications must be reasonable, Beard Papas retains significant control over the agreement's terms. This is a fairly standard practice in franchising, as it allows the franchisor to adapt to changing market conditions and improve the system.
However, it also places a degree of risk on the franchisee, who must be prepared to adapt to changes that Beard Papas implements. Prospective franchisees should carefully consider this aspect and seek clarification from Beard Papas regarding the types of modifications that may be implemented and how they could impact their business. Understanding the scope of potential changes is crucial for making an informed investment decision.
