What This Means (2025 FDD)

According to Beard Papas's 2025 Franchise Disclosure Document, the franchisor retains all rights to the Business Management System. The FDD states that upon termination of the franchise agreement, the franchisee must cease using the Business Management System Data. This includes any methods, procedures, or techniques associated with the System in which Beard Papas possesses proprietary rights or that constitute Beard Papa's trade secrets. The franchisee must also return all confidential information, including the Business Management System Data, to Beard Papas.

This means that franchisees do not acquire any ownership rights or interests in the Business Management System, including any modifications or enhancements made during the term of the franchise agreement. The Business Management System remains the exclusive property of Beard Papas.

This is a fairly standard practice in franchising, as franchisors typically maintain control over their proprietary systems and intellectual property to ensure consistency and protect their brand. Prospective franchisees should be aware that they will not have any ownership stake in the Business Management System and must adhere to Beard Papas's policies and procedures regarding its use.
