What This Means (2025 FDD)
According to the 2025 Beard Papas FDD, the Ancillary Agreements include the Owner and Spouse Agreement and Guaranty. This agreement is attached as Exhibit 1 to the franchise agreement.
During a transfer of the franchise, all obligations of the franchisee under the Franchise Agreement and the Ancillary Agreements must be assumed by the transferee, each individual owner of the transferee, and their respective spouses in a manner satisfactory to Beard Papas. This ensures that the new owners are fully responsible for all aspects of the franchise agreement.
For franchise renewals, the Renewal Ancillary Agreements are required. These agreements involve the franchisee's owners and their spouses agreeing to, signing, and delivering to Beard Papas their current individual guaranty agreements. These agreements individually and jointly guarantee the full performance of the Renewal Franchise Agreement, including payment obligations, non-compete obligations, and restrictive covenants.
