What This Means (2025 FDD)

According to Beard Papas's 2025 Franchise Disclosure Document, an Operating Manager must sign a confidentiality agreement. The Franchise Agreement allows a franchisee to hire an operating manager to oversee the day-to-day operations of their Beard Papas shop, provided the manager meets certain criteria. These criteria include meeting Beard Papa's minimum standards for managers, completing the initial training program, and signing the confidentiality agreement.

The confidentiality agreement ensures that the Operating Manager understands and agrees to protect Beard Papas's sensitive business information. This includes non-public methods, specifications, standards, policies, procedures, information, concepts, programs and systems relating to the development, establishment, marketing, promotion and operation of the Beard Papa's Shop; information concerning customers, customer lists, email lists, database lists, product sales, operating results, financial performance and other financial data of the Beard Papa's Shop; customer lists and information related to the Beard Papa's Shop; Business Management System Data; current and future information contained in the Beard Papa's Operations Manual made available to the Beard Papa's Shop by Muginoho International, Inc.; and recipes, production, cooking, and service procedures that are not disclosed to the public but used by the Beard Papa's Shop.

This requirement is a standard practice in franchising to safeguard proprietary information and maintain brand consistency. By requiring the Operating Manager to sign a confidentiality agreement, Beard Papas aims to protect its business methods, customer data, and other sensitive information from being disclosed or used improperly. This helps maintain a competitive edge and ensures that all franchised locations adhere to the same standards and practices.

Prospective franchisees should carefully review the terms of the confidentiality agreement to understand the obligations and restrictions it places on the Operating Manager. It is also important to ensure that any Operating Manager hired meets all of Beard Papas's requirements and completes the necessary training to effectively manage the shop.
