What This Means (2025 FDD)
Based on the 2025 Bb.Q Chicken Franchise Disclosure Document, the franchisee specifically acknowledges that they will receive valuable training and confidential information, including secret recipes and marketing methods. During the term of the Franchise Agreement, the franchisee is restricted from directly or indirectly engaging in activities that would violate the confidentiality and non-competition terms, unless Bb.Q Chicken provides written approval. This ensures that the franchisee does not use the franchisor's proprietary information or compete with the Bb.Q Chicken system during the agreement term.
After the termination or expiration of the Franchise Agreement, the franchisee is still bound by certain restrictions. For a period of two years, they cannot engage in any business that offers products or services similar to those offered by Bb.Q Chicken within a specific radius. This radius is defined as the greater of five miles from the former franchise location or the Designated Territory. This post-term non-compete clause protects Bb.Q Chicken's market share and prevents former franchisees from using their knowledge of the Bb.Q Chicken system to compete unfairly.
The Confidentiality and Non-Competition Agreement is designed to protect Bb.Q Chicken's trade secrets, customer relationships, and overall business interests. By agreeing to these terms, franchisees acknowledge the value of the confidential information they receive and commit to not using it to the detriment of the franchise system. These provisions are standard in franchising to maintain brand integrity and prevent unfair competition.
