Bb_Q_Chicken Franchise · 2025 FDD

Answer from 2025 FDD Document

You must obtain any architectural, engineering and design services you deem necessary for the construction of the Franchised Business at your own expense from an architectural design firm approved by us, which approval shall not be unreasonably withheld. You shall adapt the prototypical architectural and design plans and specifications for constructing or equipping the Franchised Business provided to you by us in accordance with Section 5.3 as necessary and shall submit such adapted plans to us for our review. If we determine, in our reasonable discretion, that any such plans are not consistent with the best interests of the System, we may prohibit the implementation of such plans, and in this event will notify you of any objection(s) within fourteen (14) business days of receiving such plans. If we fail to notify you of an objection to the plans within this time period, you may use such plans. If we object to any such plans, we shall provide you with a reasonably detailed list of changes necessary to make the plans acceptable. We shall, upon a re-submission of the plans with such changes, notify you within fourteen (14) business days of receiving the resubmitted plans whether the plans are acceptable. If we fail to notify you in writing of any objection within such time period, you may use the resubmitted plans. You acknowledge that our review of such plans relates only to compliance with the System and that acceptance by us of such plans does not constitute a representation, warranty, or guarantee, express or implied, by us that such plans are accurate or free of error concerning their design or structural application.

What This Means (2025 FDD)

According to Bb.Q Chicken's 2025 Franchise Disclosure Document, the franchisee is responsible for adapting the architectural and design plans and specifications for constructing or equipping the Franchised Business. Bb.Q Chicken will provide prototypical architectural and design plans and specifications, but the franchisee must independently adapt these plans at their own expense. This adaptation must be done by an architectural design firm approved by Bb.Q Chicken, with such approval not to be unreasonably withheld.

After adapting the plans, the franchisee must submit them to Bb.Q Chicken for review. Bb.Q Chicken has the right to prohibit the implementation of these plans if they are not consistent with the best interests of the Bb.Q Chicken system. Bb.Q Chicken will notify the franchisee of any objections within fourteen business days of receiving the plans. If no objection is raised within this period, the franchisee can proceed with the plans.

If Bb.Q Chicken objects to the plans, they will provide a detailed list of necessary changes. Upon resubmission of the revised plans, Bb.Q Chicken has another fourteen business days to notify the franchisee of their acceptability. Again, if no objection is received within this timeframe, the franchisee can use the resubmitted plans. The FDD clarifies that Bb.Q Chicken's review is only for compliance with the Bb.Q Chicken system and does not guarantee the accuracy or freedom from error of the plans concerning their design or structural application.
