es located or operating in your Designated Territory.

You may sell our menu items to customers who live anywhere but who choose to dine at or from your Franchised Business. You may not engage in any promotional activities or sell the proprietary products or similar products or services, whether directly or indirectly, through or on the internet, the world wide web, or any other similar proprietary or common carrier electronic delivery system (collectively, the "Electronic Media"); through catalogs or other mail order devices sent or directed to customers or prospective customers located anywhere; or by telecopy or other telephonic or electronic communications, including toll-free numbers, directed to or received from customers or prospective customers located anywhere. While you may place advertisements in printed media and on television and radio that are targeted to customers and prospective customers located within your Designated Territory, you will not be deemed to be in violation of the Franchise Agreement if those advertisements, because of the natural circulation of the printed media or reach of television and radio, are viewed by prospective customers outside of your Designated Territory. You may not directly solicit customers outside of your Designated Territory. If you are approved to provide catering/delivery services, you may do so only within the area we designate for you. What This Means (2025 FDD)

According to Bb.Q Chicken's 2025 Franchise Disclosure Document, franchisees are restricted in their online activities. Specifically, franchisees cannot engage in promotional activities or sell proprietary products or similar services through the internet, the world wide web, or any other electronic delivery system. This restriction applies whether these activities are conducted directly or indirectly.

This means a Bb.Q Chicken franchisee cannot actively market or sell their products online outside of channels approved by the franchisor. This limitation is in place to control brand consistency and prevent market overlap between franchisees and the franchisor's own online sales efforts. The FDD clarifies that Bb.Q Chicken may sell products under the Marks within and outside the Designated Territory through methods of distribution other than a Bb.Q Chicken Restaurant or Food Truck, including sales through channels of distribution such as the internet.

While franchisees are limited in their online sales and marketing, they are permitted to place advertisements in printed media, television, and radio, even if these advertisements reach potential customers outside their designated territory due to the natural circulation or reach of these media. However, franchisees are not allowed to directly solicit customers outside of their Designated Territory. This distinction highlights the franchisor's attempt to balance local marketing efforts with broader brand management and territorial protection.

Bb.Q Chicken retains the right to fulfill all orders placed through the retail portion of their website, and franchisees are not entitled to any portion of the profits received from these orders, even if the customer's order originates from or is delivered within the franchisee's Designated Territory. This further emphasizes the franchisor's control over online sales and revenue generated through the company website.
