agents who must have access to it in connection with their employment. You shall not at any time, without our prior written consent, copy, duplicate, record or otherwise reproduce such materials or information, in whole or in part, nor otherwise make the same available to any unauthorized person.

  • 7.1.7 You shall comply with all requirements of federal, state and local laws, rules and regulations.
  • 7.1.8 You shall at no time have the right to sub-franchise any of your Development Rights hereunder.
  • 7.1.9 In no event shall any Franchised Business be opened unless and until a Franchise Agreement for such Franchised Business has been fully executed and the initial franchise fee for such Franchised Business has been paid in full.

SECTION 8 OUR SERVICES

We shall, at our expense, provide the following services:

  • 8.1 Review your site selection for conformity to our standards and criteria for selection and acquisition of sites upon our receipt of your written request for approval thereof.
  • 8.2 Provide you with standard specifications and layouts for the interior and exterior design, improvements, equipment, furnishings, décor and signs identified with the Franchised Businesses as we make available to all multi-unit operators, area representatives and franchisees from time to time.
  • 8.3 Review of your site plan and final build-out plans and specifications for conformity to the construction standards and specifications of the System, upon our receipt of your written request for approval thereof.
  • 8.4 Conduct on-site evaluations, as we deem advisable, as part of our evaluation of the site for a Franchised Business.
  • 8.5 Provide such other resources and assistance as may hereafter be developed and offered by us to our other multi-unit operators.

SECTION 9 DEFAULT AND TERMINATION

  • 9.1 The occurrence of any of the following events of default shall constitute good cause for us, at our option and without prejudice to any other rights or remedies provided for hereunder or by law or equity, to terminate this Agreement upon notice to you without opportunity to cure the default, except where prohibited by any applicable state or federal law, whereupon this Agreement shall be terminated in accordance with the provisions of any such law:
    • 9.1.1 If you shall, in any respect, fail to meet the Minimum Performance Schedule.
  • 9.1.2 If you shall purport to effect any assignment other than in accordance with Section 11 hereof.

According to Bb.Q Chicken's 2025 Franchise Disclosure Document, to have a site selection reviewed for conformity to their standards, a franchisee must submit a written request for approval. Bb.Q Chicken will then review the site selection for conformity to their standards and criteria for site selection and acquisition. This service is provided at Bb.Q Chicken's expense.

Within 60 days of the Franchise Agreement's execution, the franchisee must locate a site that meets Bb.Q Chicken's site evaluation guidelines, which are provided separately. The franchisee must then submit a description of the site in the form specified by Bb.Q Chicken, along with evidence that the site meets the guidelines. This submission should also include any other information and materials reasonably required by Bb.Q Chicken, such as a letter of intent or similar evidence confirming favorable prospects for obtaining the site.

Bb.Q Chicken has 30 days after receiving all required information to approve or disapprove the proposed site at their sole discretion. The FDD clarifies that Bb.Q Chicken's acceptance of a location does not guarantee the franchisee's success or profitability at that location. Approval merely signifies that the site meets Bb.Q Chicken's minimum criteria at the time. Furthermore, the franchisee must provide a copy of the signed lease for the restaurant location within 90 days of signing the Franchise Agreement; failure to do so may result in termination of the agreement.
