What This Means (2025 FDD)

According to Bb.Q Chicken's 2025 Franchise Disclosure Document, franchisees will not receive an exclusive territory. The FDD specifies that franchisees may face competition from other franchisees, outlets that Bb.Q Chicken owns, other distribution channels, or competitive brands that Bb.Q Chicken controls. However, the Franchise Agreement will specify the Accepted Location for the Restaurant and may also specify a Designated Territory, the size and scope of which will be based on whether the location is in an urban or suburban setting and its proximity to existing Bb.Q Chicken Franchised Businesses.

For locations in a suburban area, the Designated Territory will include a minimum of 10,000 people, while in an urban area, it will include a minimum of 5,000 people. No new franchised outlets may be established within a half-mile radius of an established Bb.Q Chicken Franchised Business. If a franchisee does not yet have a location at the signing of the Franchise Agreement, they will receive a non-exclusive site search area listed in Attachment 1 of the Franchise Agreement.

The FDD also states that Bb.Q Chicken retains the right to sell products under the Marks within and outside a franchisee's Designated Territory through any method of distribution other than a Bb.Q Chicken Restaurant or Food Truck, including sales through channels of distribution such as the internet, catalog sales, grocery stores, club stores, telemarketing or other direct marketing sales. Bb.Q Chicken will fulfill all orders placed through the retail portion of their Website, and franchisees will not be entitled to any portion of the profits received from this, even if the customer's order is generated from or delivered in their Designated Territory.

For franchisees who sign a Multi-Unit Operator Agreement, Bb.Q Chicken may grant the right to develop and operate a number of Restaurants or Food Trucks in a Development Area. During the term of the Multi-Unit Operator Agreement, Bb.Q Chicken will not operate or grant a franchise for the operation of Restaurants or Food Trucks to be located within the Development Area, unless the franchisee is not in full compliance with all of the terms and conditions of the Multi-Unit Operator Agreement and all of the Franchise Agreements signed under it. However, if Bb.Q Chicken does not include the right to develop Restaurants at any Non-Traditional Site then the franchisee will not receive an exclusive territory.
