What This Means (2025 FDD)
According to the 2025 Bb.Q Chicken Franchise Disclosure Document, the Development Area is the specific geographic area outlined in Attachment 2 of the Multi-Unit Operator Agreement. Within this area, the Multi-Unit Operator has the right to establish Bb.Q Chicken restaurants and food trucks, according to the terms of the agreement.
The Development Rights granted to the Multi-Unit Operator are personal and cannot be transferred or sold, except as specified in Section 11 of the agreement. Bb.Q Chicken retains certain rights within the Development Area, including the right to develop, use, and franchise other trade names, trademarks, and service marks not designated as Marks for use with different franchise systems that do not connect to the Bb.Q Chicken system. Bb.Q Chicken also retains the right to sell its products through alternative distribution channels, even within the Development Area.
Bb.Q Chicken will not establish or authorize anyone other than the Multi-Unit Operator to establish a Bb.Q Chicken Franchised Business in the Development Area during the agreement's term, provided the operator is not in default. However, this pertains only to dedicated Bb.Q Chicken Franchised Businesses. The agreement specifies that Bb.Q Chicken's parents and/or affiliates may operate food service businesses under different marks, potentially competing with the franchisee's business.
Each Bb.Q Chicken Franchised Business developed under the Multi-Unit Operator Agreement must be established and operated according to a separate Franchise Agreement. The Multi-Unit Operator Agreement itself does not grant any rights to use the Bb.Q Chicken Marks or System; these rights are granted under the individual Franchise Agreements for each location. The franchisee must adhere to a Minimum Performance Schedule for opening new locations within the Development Area, as outlined in Attachment 1 of the agreement.
