We will grant you the right to operate your Facility under the Marks (defined below), "Baymont®", or "Baymont Inn & Suites®" in conjunction with the "by Wyndham" designation, or any new ones which are included in the System. We may ask or permit you to utilize a secondary designation with the licensed Mark for the Facility.

What This Means (2025 FDD)
According to Baymont Inn Suites's 2025 Franchise Disclosure Document, franchisees are granted the right to operate their facilities under the names "Baymont®", or "Baymont Inn & Suites®" in conjunction with the "by Wyndham" designation, or any new ones which are included in the System. Baymont Inn Suites may also ask or permit franchisees to utilize a secondary designation with the licensed Mark for the Facility. These names are registered with the United States Patent and Trademark Office.
The FDD also lists specific registered marks, including "BAYMONT" (Registration No. 2,258,085, June 29, 1999), "BAYMONT INN" (Registration Nos. 2,286,567, October 12, 1999 and 2,307,473, January 11, 2000), "BAYMONT INN & SUITES" (Registration No. 3,997,943, July 19, 2011), and "BAYMONT BY WYNDHAM" (Registration No. 5,603,330 and 5,603,344, November 6, 2018). There is also a listing for "BAYMONT | 5,619,141 | November 27, 2018 | INN | | | & | | | SUITES | | | BY | | | WYNDHAM | | |".
Baymont Inn Suites retains the right to substitute or modify these marks if the current marks become unusable or if the company believes a change would benefit the system. If Baymont Inn Suites transfers its rights under the Franchise Agreement, the purchaser may also require a substitution of names or marks. In such cases, franchisees may be required to discontinue or modify their use of existing marks and adopt additional or substitute names and identifying symbols, potentially at their own expense.
