What This Means (2025 FDD)
According to Baymont Inn Suites's 2025 Franchise Disclosure Document, Baymont Inn Suites has the discretion to permit deviations from System Standards. These deviations are based on local conditions and the company's assessment of the circumstances. Baymont Inn Suites also has the discretion to change the designation standards for the Chain and require franchisees to change the designation of their Facility and related presentation of that designation where it appears. Baymont Inn Suites will not be liable for any expenses, losses, or damages a franchisee may sustain as a result of any Mark addition, modification, substitution, or discontinuation.
This means that while franchisees are generally required to comply with the System Standards, Baymont Inn Suites retains the flexibility to make exceptions or modifications based on specific local factors. This could be beneficial for franchisees operating in unique markets where strict adherence to standard requirements may not be feasible or optimal. However, it also introduces an element of uncertainty, as the franchisee's ability to deviate from the standards is subject to Baymont Inn Suites's discretion.
Furthermore, Baymont Inn Suites reserves the right to change the designation standards for the entire chain, which could require franchisees to update their Facility's designation and presentation. While this allows Baymont Inn Suites to adapt to changing market conditions, it also means that franchisees may incur expenses to comply with these changes. It is important to note that Baymont Inn Suites is not liable for any financial losses franchisees may experience as a result of these changes. Therefore, prospective franchisees should carefully consider the potential costs and risks associated with these types of changes.
