What This Means (2025 FDD)

According to Baymont Inn Suites's 2025 Franchise Disclosure Document, franchisees must include specific entities as additional insureds on their liability insurance policies. Unless otherwise instructed by Baymont Inn Suites, the franchisee's liability insurance policies must name Baymont Franchise Systems, Inc.; Wyndham Hotels & Resorts, Inc.; Wyndham Hotel Group, LLC; and their current and former subsidiaries, affiliates, successors, and assigns as additional insureds, as their respective interests may appear.

This requirement ensures that Baymont Inn Suites and its related entities are protected from potential liabilities arising from the operation of the franchised location. By being named as additional insureds, these entities can directly benefit from the franchisee's insurance coverage in the event of a claim.

The FDD also states that all insurance policies must be primary and non-contributory, meaning they must pay out before any other insurance coverage available to the additional insureds. Franchisees must also provide annual proof of insurance coverage to Baymont Inn Suites. Failure to maintain the required insurance allows Baymont Inn Suites to procure insurance at the franchisee's expense, plus a reasonable fee.
