What This Means (2024 FDD)
According to Baya Bar's 2024 Franchise Disclosure Document, Baya Bar has the right to object to any sign, advertising media, or interior décor that a franchisee displays at their location, especially if it is outdated.
Upon notifying the franchisee of their objection, or if the franchise agreement is terminated, Baya Bar has the authority to enter the premises and remove any signs, advertising, or décor that they deem objectionable or non-approved. This includes the right to keep or destroy these items without providing any compensation to the franchisee.
Furthermore, Baya Bar is not liable for trespass or any other tort when removing these items. This clause gives Baya Bar significant control over the branding and appearance of its franchise locations, ensuring uniformity and adherence to the company's standards. It is important for prospective franchisees to understand that they must obtain approval for all signs and décor and promptly remove anything that Baya Bar deems unacceptable.
