What This Means (2024 FDD)
According to the 2024 Baya Bar Franchise Disclosure Document, the franchise agreement can be terminated if a franchisee fails to maintain the standards of quality, maintenance, repairs, and sanitation required by the Baya Bar system. Specifically, if a franchisee fails to operate in accordance with the general standards of quality, maintenance, repairs, and sanitation required by the System, it constitutes a default of the agreement. Following such a default, Baya Bar has the option to terminate the Franchise Agreement.
Baya Bar requires franchisees to equip and maintain their locations to specific standards of decor, sanitation, repair, and condition as detailed in the manual and other written directives. Franchisees are responsible for making necessary additions, alterations, repairs, refurbishing, and replacements to meet these standards, including repainting and repairing or replacing worn items. Franchisees must also operate and maintain the location in conformance with best practices for food and beverage handling to ensure the highest possible rating from inspecting governmental authorities.
This means that a Baya Bar franchisee must consistently meet the brand's standards for cleanliness, upkeep, and food safety. Failure to do so, as determined by inspections or other means, can lead to the termination of the franchise agreement. Prospective franchisees should carefully review the Baya Bar operations manual and other directives to fully understand these standards and ensure they can consistently meet them. Maintaining these standards is crucial not only for avoiding termination but also for upholding the brand's reputation and ensuring customer satisfaction.
