What This Means (2024 FDD)
According to Baya Bar's 2024 Franchise Disclosure Document, Baya Bar may establish other shops in a franchisee's area if permitted under the Franchise Agreement. Additionally, Baya Bar may sell or license others to sell products in a franchisee's area. Baya Bar also retains the right to sell products through the internet, toll-free telephone numbers, catalogs, or other similar means of distribution to customers at any location, even within a franchisee's area.
This means that while a franchisee may have a designated territory, Baya Bar retains some rights to operate or allow others to operate within that same area under certain conditions. This could potentially lead to increased competition for the franchisee. The specifics of when and how Baya Bar can establish other shops or sell products in a franchisee's area would be detailed in the Franchise Agreement.
Prospective franchisees should carefully review the Franchise Agreement to understand the extent of territorial protection offered and the conditions under which Baya Bar can establish additional outlets or sell products within their territory. Understanding these conditions is crucial for assessing the potential for competition and the overall value of the franchise opportunity. It is important to note that the FDD states that the acai market is relatively new and not as competitive, but this could change over time.
