What This Means (2024 FDD)
According to Baya Bar's 2024 Franchise Disclosure Document, Baya Bar will conduct an onsite evaluation of a potential site if they deem it necessary. However, before Baya Bar conducts the evaluation, the franchisee must first submit a description of the site, evidence that the site satisfies Baya Bar's site selection guidelines, and any other information or materials that Baya Bar may reasonably require. This includes a letter of intent or other evidence confirming favorable prospects for obtaining the site.
It is important to note that the franchisee bears all costs, liabilities, expenses, and responsibility for locating, obtaining, and developing a site for the Baya Bar shop, as well as for constructing and equipping the shop at the accepted site. The franchisee must select a site that meets Baya Bar's site selection guidelines, but Baya Bar retains the right to approve deviations from these standards based on the individual factors of a particular site.
This process highlights the importance of thorough due diligence on the franchisee's part in identifying a suitable location. While Baya Bar offers site selection guidelines and may conduct an onsite evaluation, the ultimate responsibility for finding and developing an appropriate site rests with the franchisee. The franchisee should carefully review Baya Bar's site selection criteria and gather all necessary documentation before submitting a site for approval.
