What This Means (2024 FDD)
According to Baya Bar's 2024 Franchise Disclosure Document, any advertising, marketing, or sales concepts, programs, or materials that a franchisee proposes or develops for the Baya Bar brand, and which are approved by Baya Bar, may be used by other franchisees in the Baya Bar system.
This means that if a Baya Bar franchisee comes up with a successful marketing idea or advertising campaign and Baya Bar approves it, Baya Bar has the right to share that idea with other franchisees in the system. The franchisee who originated the idea will not receive any compensation for its use by other franchisees.
This clause encourages franchisees to contribute innovative ideas to the Baya Bar system, but it also means that franchisees may not directly benefit financially from their own creative contributions if those ideas are adopted system-wide. Prospective franchisees should consider this when deciding whether to invest in a Baya Bar franchise, as it highlights the collaborative nature of the franchise system and the potential for shared resources and strategies.
