We have the right to require you to use a real estate broker we designate to assist you in finding a location for your Shop. You must provide us with a copy of the fully signed lease for the Shop premises. We may require you and your landlord to sign a Collateral Assignment of Lease which permits us to assume your lease in certain circumstances including the termination or expiration of your Franchise Agreement (Attachment B to the Franchise Agreement).

What This Means (2024 FDD)
According to Baya Bar's 2024 Franchise Disclosure Document, Baya Bar does have the right to require franchisees to use a real estate broker that they designate. This requirement is related to site selection for the Baya Bar shop. Before a franchisee acquires a site, Baya Bar must accept the site. Additionally, Baya Bar must accept any contract of sale or lease before the franchisee signs it.
This means that a prospective Baya Bar franchisee might not be able to use their preferred real estate broker and instead must use one chosen by the franchisor. Furthermore, Baya Bar requires that the franchisee provide them with a copy of the fully signed lease for the shop premises. Baya Bar may also require the franchisee and their landlord to sign a Collateral Assignment of Lease, which allows Baya Bar to assume the lease under certain conditions, such as the termination or expiration of the Franchise Agreement.
