What This Means (2024 FDD)
According to the 2024 Baya Bar Franchise Disclosure Document, the obligation to protect confidential information extends beyond the term of the agreement. As a Baya Bar developer, you are exposed to trade secrets, recipes, customer lists, and other proprietary information, all classified as "Confidential Information."
During the agreement and after it expires or terminates, you cannot share or use this Confidential Information for your own or anyone else's benefit. This restriction is perpetually binding, meaning it continues indefinitely even after the agreement ends.
To protect this information, you must take necessary steps at your own expense and notify Baya Bar if any confidential details are revealed against the agreement. This ensures that Baya Bar's competitive advantage and proprietary knowledge remain secure, even after your association with the franchise concludes.
