What This Means (2024 FDD)

According to Baya Bar's 2024 Franchise Disclosure Document, the franchisee is solely responsible for the safety and security of their Baya Bar location. This responsibility extends to the franchisee, their personnel, customers, agents, and the general public.

Any suggestions that Baya Bar offers regarding safety and security are for guidance only and are not binding on the franchisee. The franchisee has full discretion and control over all safety and security matters at their location.

This means that while Baya Bar may provide recommendations or best practices, the franchisee ultimately decides what measures to implement. However, the franchisee's indemnification obligations, as detailed in Section 15.6 of the agreement, apply to any claims made against Baya Bar related to safety or security issues at the franchised location. This highlights the importance of franchisees carefully considering and addressing safety and security concerns to protect themselves and Baya Bar from potential liabilities.
