What This Means (2024 FDD)
According to Baya Bar's 2024 Franchise Disclosure Document, franchisees must adhere to the standards and specifications outlined in the manual or in writing for all fixtures, furnishings, and equipment, including computer hardware, software, and point of sale systems. Deviation from these standards requires prior written consent from Baya Bar. Franchisees are prohibited from installing any items on the premises that do not comply with Baya Bar's specifications or without written consent. This ensures uniformity and quality across all Baya Bar locations.
Baya Bar maintains strict control over the products and services used in the franchise system to ensure quality and uniformity. Franchisees must operate their shops in strict conformity with the methods, standards, and specifications prescribed by Baya Bar in its manual or other written materials. This includes maintaining sufficient supply and using only approved food and beverage items, ingredients, products, materials, supplies, and paper goods that meet Baya Bar's standards. All menu items must be prepared according to specified recipes and procedures. Franchisees cannot deviate from these standards by using non-conforming items or differing amounts of items without prior written consent.
Baya Bar reserves the right to modify its standards and specifications as deemed necessary, providing franchisees with written notice of any changes. To ensure compliance, Baya Bar or its agents may, during normal business hours, remove samples of food or non-food items from the franchisee's inventory for testing. If a sample fails to conform to Baya Bar's specifications or if the supplier has not been previously approved, the franchisee may be required to pay for the inspection and testing costs. This rigorous oversight helps maintain the brand's quality and consistency.
To further control quality and uniformity, Baya Bar requires franchisees to purchase or lease fixtures, furnishings, equipment, and other products from suppliers who demonstrate the ability to meet Baya Bar's standards. A complete list of approved products and suppliers is included in the manual and is subject to change. Franchisees must also use designated suppliers for specific services, such as Vuda Media S Corp for web and social media management and Square, Inc. for the point of sale system. While Baya Bar may negotiate purchase arrangements with suppliers on behalf of the system, franchisees must comply with the approved supplier list and standards to maintain consistency and quality across all locations.
