What This Means (2024 FDD)

Based on the 2024 Franchise Disclosure Document, Baya Bar franchisees must ensure the safety and security of their business location. The franchisee is solely responsible for the safety and security of the location for themselves, their personnel, customers, agents, and the general public. Any suggestions from Baya Bar on safety and security are for guidance only and not binding on the franchisee.

This means that Baya Bar franchisees have full discretion and control over all safety and security matters at their location. They are also obligated to indemnify Baya Bar against any claims related to safety or security issues. This indemnification extends to any losses, expenses, or liabilities incurred by Baya Bar due to incidents at the franchisee's location.

This requirement places a significant responsibility on the franchisee. They must proactively manage risks and implement appropriate measures to protect everyone at the premises. Franchisees should consult with legal and insurance professionals to ensure they have adequate coverage and procedures in place to address potential safety and security concerns. This is a common practice in the franchise industry, where franchisees typically bear the responsibility for day-to-day operations and risk management within their specific location.
