Answer from 2024 FDD Document

Before you lease or purchase the site for the Shop, you must locate a site that satisfies our site selection guidelines. If we deem it necessary we will conduct one onsite evaluation, but before we conduct the evaluation you must submit to us in the form we specify a description of the site, including evidence that the site satisfies our site selection guidelines, together with other information and materials that we may reasonably require, including a letter of intent or other evidence that confirms your favorable prospects for obtaining the site.

What This Means (2024 FDD)

According to Baya Bar's 2024 Franchise Disclosure Document, Baya Bar will conduct one onsite evaluation if they deem it necessary. However, before Baya Bar conducts the evaluation, the prospective franchisee must submit a description of the site, including evidence that the site satisfies Baya Bar's site selection guidelines. This submission must be in a specified form and include other information and materials that Baya Bar may reasonably require, such as a letter of intent or other evidence confirming favorable prospects for obtaining the site.

This means that while Baya Bar reserves the right to evaluate the site in person, the franchisee bears the initial responsibility of demonstrating that the location meets the franchisor's criteria. The franchisee needs to compile and present a comprehensive package of information to Baya Bar for review. This process ensures that Baya Bar can make an informed decision about whether an onsite visit is warranted.

It is important to note that even if Baya Bar conducts an onsite evaluation, the franchisee remains responsible for all costs, liabilities, expenses, and responsibilities related to securing and developing the site. The onsite evaluation is simply a part of Baya Bar's approval process and does not shift the burden of due diligence or financial responsibility to the franchisor.
