What This Means (2025 FDD)
According to Batteries Plus Bulbs's 2025 Franchise Disclosure Document, Exhibit A will be updated to identify the Protected Area once Batteries Plus Bulbs consents to a location for the store within the geographic area established in Alternative Exhibit A.
Initially, instead of Exhibit A, Batteries Plus Bulbs and the franchisee may complete and sign Alternative Exhibit A. This alternative exhibit establishes a geographic area where the store location will be determined, subject to Batteries Plus Bulbs's written acceptance, at least 150 days before the scheduled store opening date. It is important to note that the initial designation of a geographic area in Alternative Exhibit A does not grant the franchisee any territorial rights, and Batteries Plus Bulbs retains the right to operate or franchise other stores within that designated area.
This process allows for a preliminary agreement on a broader geographic area before a specific site is chosen. Once a specific location is approved within that area, the update to Exhibit A formally defines the franchisee's Protected Area, which provides certain territorial protections as outlined in the franchise agreement.
