What This Means (2025 FDD)
According to the 2025 Batteries Plus Bulbs Franchise Disclosure Document, exhibits attached to the franchise agreement are integral parts of the agreement. Specifically, Exhibit A outlines the geographic area where the franchisee can propose a store location.
Exhibit A requires the franchisee to select a location at least 180 days before the scheduled opening date and to obtain the franchisor's acceptance of that location. Batteries Plus Bulbs will evaluate the proposed location based on factors like demographics, traffic patterns, parking, the character of the neighborhood, proximity to other businesses (including other Batteries Plus Bulbs stores), commercial characteristics, lease terms, and the size and appearance of the premises. The franchisor has 30 days to either accept or reject the proposed location in writing after receiving a complete site report from the franchisee.
The document emphasizes that Batteries Plus Bulbs' acceptance of a location does not constitute a warranty or representation about the location's suitability. Furthermore, Batteries Plus Bulbs has the right to terminate the franchise agreement if the franchisee fails to secure location approval at least 180 days before the planned opening. All capitalized terms within Exhibit A that are not defined within the exhibit itself carry the same meaning as defined in the franchise agreement.
