- B. Designated Area. "Designated Area" means the geographic area described in Exhibit A.
For purposes of this Section, the term "Market Area" means the geographic area
encompassing a radius of twenty (20) miles from the location of the Store identified in Exhibit A attached hereto.
Subject to the provisions contained in this Agreement, Franchisor grants Franchisee a franchise (the "Franchise") to own and operate a Batteries Plus® Store at a site approved by Franchisor and to use the Licensed Marks in operating the Store.
The location of the Store and Franchisee's Protected Area are identified in Exhibit A, or alternatively, Franchisor and Franchisee will complete and sign Alternative Exhibit A, in which Franchisor and Franchisee agree upon a geographic area in which the location of the Store will be established, subject to Franchisor's written acceptance, at least one hundred and fifty days (150) days before the date the Store is scheduled to open as stated in Exhibit A or Alternative Exhibit A.
- F. "Protected Area" means the geographic area identified in Exhibit A.

What This Means (2025 FDD)
According to the 2025 Batteries Plus Bulbs FDD, the "Designated Area" is defined in Exhibit A of the franchise agreement. Specifically, Section 1(B) defines "Designated Area" as the geographic area described in Exhibit A.
For a prospective franchisee, this means the specific boundaries of your territory, if any, will be detailed in Exhibit A, which is a crucial document to review carefully. This exhibit will outline the area where you have certain rights or responsibilities, and it's important to understand the extent of this area before signing the agreement.
It is important to note that the FDD also mentions a "Protected Area" which is also identified in Exhibit A. Understanding the difference between the Designated Area and the Protected Area is crucial. The Designated Area seems to apply more to Multiple Unit Franchise Agreements, while the Protected Area defines the area where Batteries Plus Bulbs will not operate or franchise another full-service store, offering a degree of exclusivity. Batteries Plus Bulbs also uses the term "Market Area" which encompasses a radius of twenty (20) miles from the store location.
