- (b) Franchisor is under no obligation to provide Franchisee with access to branded social media pages or other social media assets. Any social media pages or other social media assets that Franchisor, in its sole discretion, chooses to make available to Franchisee will be provided only on condition that Franchisee updates them regularly. Any such social media pages or other social media assets maintained by Franchisee shall be deemed "advertising" and shall be subject to all terms of this Section 6.8. Franchisor has the right, but not the obligation, to conduct social media campaigns on behalf of all, or any subset of, Franchisees via local social media.

What This Means (2025 FDD)
According to Bath Tune Up's 2025 Franchise Disclosure Document, any social media pages or other social media assets that Bath Tune Up chooses to make available to a franchisee are provided only on the condition that the franchisee updates them regularly. Any such social media pages or other social media assets maintained by the franchisee are considered "advertising" and are subject to all the terms outlined in Section 6.8 of the agreement.
Bath Tune Up maintains final authority over all social media marketing, and franchisees must comply with Bath Tune Up's brand standards regarding social media use in their franchise operations. Franchisees are prohibited from posting communications that disclose confidential or proprietary information, violate laws or regulations, or breach the social media site's terms of use. Additionally, franchisees cannot post on any public-facing social media site not authorized by Bath Tune Up.
Bath Tune Up requires that franchisees grant them administrator access rights to the franchisee's social media pages. All uses of a franchisee's social media pages and communication channels must be established and maintained in compliance with the manuals provided by Bath Tune Up. Franchisees must also ensure that their employees' social media policies align with the requirements for social media advertising as set forth in the franchise agreement.
Franchisees must promptly discontinue any social media advertising or promotion, regardless of prior approval from Bath Tune Up, if Bath Tune Up reasonably considers that the use of social media does not conform to the system standards. Upon the expiration or termination of the franchise agreement, the franchisee will assign ownership of all domain names, account names, handles, and usernames used in their business to Bath Tune Up, to the extent that Bath Tune Up does not already own them. The franchisee will also take all actions reasonably required by Bath Tune Up to disassociate themselves from any such names and social media pages.
