According to Bath Tune Up's 2025 Franchise Disclosure Document, Bath Tune Up retains all rights and interests in its website's URL. The FDD states that Bath Tune Up owns the domain name "BATH TUNE-UP®", the URL, and all existing and future domain names, URLs, addresses, and subaddresses. This ownership extends to all computer programs, code, text, images, sounds, files, video, designs, animations, layout, color schemes, trade dress, concepts, methods, techniques, processes, and data used on or collected through Bath Tune Up's website.
This means that Bath Tune Up has the authority to modify its website's URL as it sees fit. As a franchisee, you must use the Marks to sell goods or services through the Internet in compliance with the Manuals or with Bath Tune Up's prior written consent, and in accordance with the procedures, policies, standards, and specifications that Bath Tune Up establishes from time to time.
Bath Tune Up may also modify, expand, or eliminate its website at its option and can establish programs that refer end-users to other websites or receive referrals from other websites. All revenue from advertisements, endorsements, sponsorships, and affiliate programs on Bath Tune Up's website belongs solely to Bath Tune Up. Bath Tune Up's website may include pages dedicated to franchisees, including the Franchised Business, with information such as geographic region, address, and telephone numbers. Bath Tune Up may also establish pages dedicated to franchise sales or investor relations.
Bath Tune Up may allow franchisees to customize or post information on a dedicated Franchisee Page, but this is subject to Bath Tune Up's procedures, policies, standards, and specifications. Any modifications made by the franchisee are considered a "work made for hire," giving Bath Tune Up ownership of the intellectual property rights. If a modification does not qualify as a work made for hire, the franchisee must assign the modifications to Bath Tune Up.
