What This Means (2025 FDD)
According to Bath Tune Up's 2025 Franchise Disclosure Document, if a franchisee seeks to transfer their interest in the franchise agreement to another party, the proposed assignee must demonstrate certain qualifications to the franchisor. Specifically, the proposed assignee must show that they possess the skills, qualifications, and economic resources necessary to successfully operate the Bath Tune Up business. This assessment is made at the franchisor's reasonable discretion.
Bath Tune Up will consider various factors when evaluating a potential transferee. These factors include the prospective transferee's experience in or ability to learn the bathroom improvement business, their financial and operational skills, their available economic resources, and their overall reputation and character. The franchisor also assesses the ability of the proposed transferee to fully and faithfully conduct the franchised business according to the franchise agreement.
In practical terms, this means that a franchisee looking to sell their Bath Tune Up franchise needs to find a buyer who not only has the financial means to invest in the business but also possesses the aptitude and background to manage and grow the franchise successfully. The franchisor has significant discretion in approving or denying a transfer, so finding a qualified buyer is crucial for the sale to proceed smoothly. This protects the Bath Tune Up brand by ensuring new franchisees are well-equipped to succeed.
