7.11. Initial Promotion and Advertising
Franchisor shall assist Franchisee in developing the pre-opening, and initial post-opening promotion of the Franchised Business. Franchisor will, from time to time, provide Franchisee with promotional and advertising information.
8. OPERATION OF BUSINESS
8.1. Franchisee Operational Requirements
- (a) Manager. Franchisee will employ or engage the services of, on a full time basis, at least one Manager who will devote his or her entire time and attention during normal business hours, as defined in the Manuals, to the management, operation, and development of the Franchised Business in a manner that maximizes Gross Revenue consistent with sound marketing and business practices and will not engage in any other business activity requiring his or her active participation during normal business hours.
- (b) Vehicle. At any time after the Effective Date, but before the Operating Date, Franchisee must purchase or lease at Franchisee's expense a motor vehicle or motor vehicle and enclosed trailer meeting Franchisor's standards, as set forth in the Manuals (a "Vehicle") for use in the Franchised Business.

What This Means (2025 FDD)
According to Bath Tune Up's 2025 Franchise Disclosure Document, a franchisee must employ or engage the services of at least one full-time manager. This manager is responsible for the day-to-day operation of the franchised business and must devote their entire time and attention during normal business hours to the management, operation, and development of the business. The manager's primary goal is to maximize gross revenue while adhering to sound marketing and business practices. The manager cannot engage in any other business activity that requires their active participation during normal business hours.
The FDD defines a "Manager" as the employee or agent of the franchisee who is designated to be responsible for the daily operations and has successfully completed the initial training program. If the franchisee is an individual, they may act as the manager themselves.
Before the manager begins the Training Programs, if the franchisee is not the manager, the manager must deliver a signed confidentiality agreement to Bath Tune Up. This agreement must be in the form included in the Manuals. The franchisee or the manager must complete the Initial Training Program before the Operating Date.
