What is the consequence if a Bath Tune Up franchisee seeks a passive investment?
Bath_Tune_Up Franchise · 2025 FDDAnswer from 2025 FDD Document
The business you will conduct under a BATH TUNE-UP® franchise (the "Franchised Business") is the sale of bathroom remodels and updates ("Bath Improvements"). Bathroom remodels replace the entire bathroom from floor to ceiling including flooring, vanities, countertops, faucets, lighting, plumbing, storage, showers, tubs, conversions and reconfigurations. Bathroom updates involve the sale and installation of bathtub and shower surrounds, conversions of bathtubs to showers and showers to bathtubs, glass shower walls, lighting fixtures, plumbing fixtures such as toilets, walk-through, jetted and soaker tubs, sinks, mirrors, vanity replacements, cabinet hardware, and organizers. You will also sell other services and products generally related to home improvement and remodeling, such as flooring, general construction material, plumbing, and electrical repairs and replacement. You may be required to offer additional related services and products as we develop or refine them. You will use a motor vehicle identified with signage we specify to make sales calls and perform work.

What This Means (2025 FDD)
Based on the 2025 Bath Tune Up Franchise Disclosure Document, the document does not explicitly address the consequences if a franchisee seeks a passive investment. The FDD does not describe any restrictions on the level of involvement a franchisee must have in the day-to-day operations of the Bath Tune Up business.
However, the FDD does state that the franchisee will conduct the Bath Tune Up business, implying an active role. The agreement also specifies that the franchisee must use a vehicle with specified signage to make sales calls and perform work, suggesting a hands-on approach to the business.
Therefore, a prospective franchisee should clarify with Bath Tune Up the extent to which passive ownership is permitted and what specific obligations a franchisee must fulfill to maintain compliance with the franchise agreement. This information is crucial for individuals considering investing in a Bath Tune Up franchise without intending to be actively involved in its daily operations.
