Does ProVision disclaim any implied warranties beyond those expressly stated in the agreement for Basecamp Fitness?

According to Basecamp Fitness's 2025 Franchise Disclosure Document, ProVision, in its agreement with the franchisee, provides a disclaimer of warranty. While ProVision warrants that it has the authority to enter the agreement and will perform services in a commercially reasonable manner, it explicitly disclaims all other warranties.

Specifically, ProVision disclaims any implied warranties of non-infringement, merchantability, and/or fitness for a particular purpose concerning any subject matter of the agreement. This means that beyond the express warranties provided, the franchisee cannot hold ProVision liable for any implied guarantees about the quality, suitability, or legality of the services or materials provided.
