Is a Basecamp Fitness franchisee protected from Anytime Fitness franchisees?

If a site has not been identified, then we will designate an area, and you may locate your Basecamp Studio at any site we approve within that area, so long as the site you select is not also within a territory of another Basecamp Studio or an Anytime fitness franchisee (for a limited time as discussed below).
There may be now, or in the future, Orangetheory, Anytime Fitness and/or Bar Method locations in the same market as current or future Basecamp Fitness franchisee territory(ies). All of the businesses that our affiliates and their franchisees operate may solicit and accept business from customers near your business. If there is a conflict between us and an Anytime Fitness franchisee and/or a Bar Method franchisee or between a Basecamp Fitness franchisee and an Anytime Fitness franchisee and/or a Bar Method franchisee, in either case regarding territory, members or franchisor support, we will attempt to resolve the conflict after taking into account the specific facts of each situation and what is in the best interest of the affected system or systems. However, we do not have a policy related to, and are not responsible for, resolving conflicts between a Basecamp Fitness franchisee and an Orangetheory franchisee. We also have no obligation to resolve conflicts between or among Anytime Fitness franchisees and Bar Method franchisees.

What This Means (2025 FDD)
According to Basecamp Fitness's 2025 Franchise Disclosure Document, a franchisee's protected territory may offer some limited protection against Anytime Fitness franchisees. When initially selecting a site for a Basecamp Studio, the franchisor will designate an area where a franchisee can locate their studio, provided the site is not within the territory of another Basecamp Studio or an Anytime Fitness franchisee. This protection from Anytime Fitness franchisees is only applicable for a limited time during the initial site selection. Once the site is approved, Basecamp Fitness grants a protected territory, but the details of this protection in relation to Anytime Fitness are not fully clarified.
However, the FDD also states that there may be existing or future Orangetheory, Anytime Fitness, and/or Bar Method locations within the same market as a Basecamp Fitness franchisee's territory. If conflicts arise between Basecamp Fitness and Anytime Fitness franchisees regarding territory, members, or franchisor support, Basecamp Fitness will attempt to resolve the conflict, considering the specific facts and the best interests of the affected systems. Basecamp Fitness does not have a policy for resolving conflicts between a Basecamp Fitness franchisee and an Orangetheory franchisee, nor are they obligated to resolve conflicts between Anytime Fitness and Bar Method franchisees.
In summary, while there is an initial consideration to avoid placing a Basecamp Fitness studio within an Anytime Fitness franchisee's territory during site selection, there is no guarantee of ongoing protection from Anytime Fitness locations or competition once the Basecamp Fitness studio's protected territory is established. A prospective franchisee should seek clarification from Basecamp Fitness regarding the extent and duration of territory protection against Anytime Fitness and other competing fitness brands.
