What This Means (2025 FDD)
According to Basecamp Fitness's 2025 Franchise Disclosure Document, franchisees must comply with all applicable local, state, federal, and municipal laws, ordinances, rules, and regulations pertaining to the operation of their Basecamp Studio. This includes, without limitation, health and safety regulations. The FDD emphasizes the franchisee's responsibility to maintain a safe and compliant studio environment.
Specifically, the franchisee is responsible for determining and obtaining all necessary licenses and permits required by law for their Basecamp Studio and maintaining these throughout the term of the agreement. This includes consulting with an attorney to ensure compliance with all relevant laws. The franchisee must also comply with all laws and regulations relating to privacy and data protection and must comply with any privacy policies or data protection and breach response policies that Basecamp Fitness may periodically establish.
Furthermore, the franchisee is obligated to notify Basecamp Fitness immediately of any suspected data breach at or in connection with the Basecamp Studio. While the FDD does not explicitly define what constitutes a threat or danger to public health and safety, it underscores the franchisee's responsibility to adhere to all health and safety regulations, maintain necessary licenses and permits, and address any potential data breaches promptly. This suggests that any failure to comply with these regulations, maintain necessary permits, or address data breaches could be construed as a threat or danger to public health and safety.
