What This Means (2024 FDD)
According to Bang Cookies's 2024 Franchise Disclosure Document, the dispute resolution process is the same for both the Franchise Agreement and the Multi-Unit Development Agreement.
Specifically, both agreements stipulate that, with the exception of claims for injunctive relief, all disputes must initially undergo non-binding mediation in Bergen County, New Jersey. If mediation proves unsuccessful, the dispute will then proceed to binding arbitration, also in Bergen County, New Jersey. This process is subject to applicable state law.
Furthermore, the Franchise Agreement and the Multi-Unit Development Agreement both specify that all mediation, arbitration, and litigation proceedings, if applicable, must be conducted in the state court of general jurisdiction within or closest to Bergen County, New Jersey, and are subject to applicable state law. Both agreements are governed by New Jersey law, but this is also subject to state law and any disclosures made in Exhibit I of the Disclosure Document. Therefore, the method of dispute resolution is consistent across both agreement types.
