How might Bang Cookies identify the Designated Territory?

Once you identify a site that we approve for your Shop Location we will designate an area around your site as your designated territory (the "Designated Territory"). There is no minimum size for a designated territory, the scope and size of your Designated Territory will, generally, be a distance of three miles from the Shop Location in all directions travelable by road, but may be smaller based on population density, demographics, and geographical boundaries. If your Shop is located within a shopping mall or a similar facility with a captive market, your Designated Territory may be limited to the physical boundaries of the mall or facility. Depending on the demographics and geography we may designate your Designated Territory where your Shop is located at the center of the Designated Territory or where your Shop is located elsewhere within the Designated Territory. We may identify your Designated Territory by zip code, boundary streets, highways, county lines, designated market area, and/or other recognizable demarcations.

What This Means (2024 FDD)

According to Bang Cookies's 2024 Franchise Disclosure Document, after a franchisee identifies a site that Bang Cookies approves for their Shop Location, Bang Cookies will designate an area around the site as the franchisee's Designated Territory. The size and scope of the Designated Territory is generally a distance of three miles from the Shop Location in all directions travelable by road, but may be smaller based on population density, demographics, and geographical boundaries. If the Shop is located within a shopping mall or similar facility with a captive market, the Designated Territory may be limited to the physical boundaries of the mall or facility.

Bang Cookies may designate a Designated Territory where the Shop is located at the center of the territory, or elsewhere within it, depending on demographics and geography. The FDD specifies that Bang Cookies may identify the Designated Territory by zip code, boundary streets, highways, county lines, designated market area, and/or other recognizable demarcations.

It is important to note that Bang Cookies does not grant exclusive territories. Franchisees may face competition from other franchisees, outlets that Bang Cookies owns, or other channels of distribution or competitive brands that Bang Cookies controls. However, Bang Cookies states that during the term of the Franchise Agreement, provided the franchisee is not in default of their obligations, Bang Cookies will not establish or open, nor grant another franchisee the right to establish or open, a Bang Cookies Shop at a Shop Location within the franchisee's Designated Territory, except for Reserved Rights.
