Does Bang Cookies have brand standards regarding the appearance of the Franchised Business?

WHEREAS, Franchisor has developed a distinctive and proprietary system (the "System") for the establishment, development and operation of a Shop a cookie shop that bakes and sells on-site giant, softbaked, organic cookies and baked goods in various flavors using natural ingredients, and other products and services (each, a "Franchised Business" or "Shop");
WHEREAS, the System and, therefore, each Shop is identified by the Marks (defined below) and distinctive trade dress, service offerings, business formats, equipment, products, supplies, operating procedures, programs, methods, procedures, and marketing and advertising standards, all of which are part of the System and all of which Franchisor may modify from time to time;
WHEREAS, Franchisee agrees that adherence to the terms of this Agreement, each and every Shop individual unit Franchise Agreement, Franchisor's operations manual, and Franchisor's System standards and specifications, are essential to the operation of all Bang Cookies Shops and the System as a whole.
Franchisee shall, at all times, ensure that all advertising and promotion of the Franchised Business by Franchisee is completely factual and conforms to the highest standards of ethical advertising, and is in conformity with Franchisor's standards and specifications.
Franchisor, in Franchisor's sole discretion, shall possess, among other things, the unilateral right to reject any and all advertising relating to the Franchised Business, Franchisor, the System, Bang Cookies Shops and/or using the Licensed Marks.
"Know-How" refers to means our trade secrets and proprietary information relating to the development, establishment, marketing, promotion and/or operation of a Bang Cookies Shop including, but not limited to, methods, techniques, inventory, products and services standards and specifications and information reflected in, included in, comprising and/or constituting a part of the System.
Franchisor's Reasonable Business Judgment" refers to, means, and relates to any and all decisions, actions and choices made by Franchisor concerning or relating to this Agreement, the System generally, Bang Cookies Shops and/or the Franchised Business where Franchisor undertakes or makes such decision with the intention of benefitting or acting in a way that could benefit the System.

This includes methods, techniques, inventory, product and service standards, specifications, and information within the operations manual and confidential information. The franchisor also makes decisions with the intention of benefitting the Bang Cookies system, including enhancing the value of the licensed marks, increasing customer satisfaction, minimizing customer confusion, expanding brand awareness, and implementing marketing and accounting control systems.
These standards ensure uniformity across all Bang Cookies locations, maintaining brand consistency and customer expectations. Prospective franchisees should carefully review the operations manual and franchise agreement to understand the full scope of these standards and requirements. Franchisees must also disclose to Bang Cookies any ideas, concepts, methods, and products conceived or developed relating to the development and operation of Bang Cookies Shops.
