What This Means (2024 FDD)
According to Bang Cookies's 2024 Franchise Disclosure Document, a franchisee is prohibited from representing themselves as a former Bang Cookies franchisee after the franchise agreement ends. This restriction takes effect immediately upon the expiration, termination, or transfer of the agreement for any reason.
This provision is designed to protect Bang Cookies's brand and reputation by ensuring that individuals no longer associated with the franchise do not misrepresent their affiliation. It prevents potential confusion among customers and maintains the integrity of the Bang Cookies brand. Franchisees must cease all operations under the Bang Cookies system and refrain from using any materials or information associated with the franchise.
For a prospective franchisee, this means that once the franchise agreement concludes, they cannot leverage their past association with Bang Cookies for any business or promotional activities. This includes stating in any form of advertising or communication that they were previously a Bang Cookies franchisee. This restriction is a standard practice in franchising to maintain brand consistency and prevent unauthorized use of the franchisor's intellectual property.
Failure to comply with this provision could result in legal action by Bang Cookies to protect its brand and enforce the terms of the franchise agreement. Therefore, it is crucial for franchisees to understand and adhere to these post-termination obligations to avoid any potential disputes.
