Electronic Point-Of-Sale and Computer Systems

You must purchase or lease a Point of Sale (POS) system in order to operate the Franchised Business. You may substitute alternate equipment only if approved by us. We reserve the right to require that this system be upgraded or modified on a system-wide basis at any time. There is no limit on the frequency or cost of this obligation. All franchisees are required to have internet capability available. The cost of purchasing the Point of Sale system ranges from $10,000 to $15,000. If you lease the Point of Sale System Your lease cost will vary upon the length of term leased, Your credit and other factors used by leasing companies. You will need to purchase the managed services (menu and database) for your Point of Sale System from the approved supplier, which fees are approximately $800 - $1,000 per year.

The Point of Sale system will generate information with regard to sales including, but not limited to, continuity of transactions, sales tax information, and product mix information. We may require electronic transmission of this information. We may have independent access to this information and data. In order to operate the current Oracle/Simphony Point of Sale system, certain employee personal information must be provided to set up employee data in the Point of Sale System. We will: (i) use reasonable and appropriate measures to safeguard the security of the personal information, including providing access to the personal information only to those responsible for the operation and maintenance of the Point of Sale system, who have a need for such access, (ii) use that personal information only for purposes related to the operation of the Point of Sale system, and (iii) not disclose that personal information except as required under applicable law.

There may be a maintenance/help desk fee of approximately $1,100 - $1,500 per year for the Point of Sale system. There may be a SAAS (Software As A Service) fee of approximately $750 per year, per terminal for the Point of Sale software license.
