8. OPERATION AND MANAGEMENT OF THE RESTAURANT
- (a) In order to maintain the high quality and uniform standards associated with the System, and to promote and protect Franchisor's good will and reputation, Franchisee agrees from the day it opens the Restaurant through expiration of the Term:
- (i) To operate the Restaurant exclusively as a Restaurant under the Marks, in strict conformity with the Confidential Operations & Training Manual referred to in Section 13, and not to engage in any other type of business at the franchised location;
- (ii) To sell all food, menu items and other products required by Franchisor, and not to sell any other food, menu items or products at the Premises;
- (iii) To equip, maintain, staff and operate the Restaurant strictly in accordance with the methods, procedures and techniques as are, from time to time, established by Franchisor in its Confidential Operations & Training Manual or otherwise;
- (iv) To vigorously and aggressively promote the business, by making use of the advertising, sales promotion and merchandise materials and programs developed and prescribed, from time to time, by Franchisor.
- (v) To keep the Restaurant open for business the minimum number of days per week, and hours per day, prescribed by Franchisor, from time to time, or as required by the lease, if different from those prescribed by Franchisor;
- (vi) To keep and maintain the Restaurant, and its appearance, in a clean and orderly manner, consistent with the Confidential Operations & Training Manual, and in accordance with the
directives of Franchisor, which Franchisor deems necessary to protect the standards of quality and uniformity established by it for the System;
- (vii) To comply, at all times, with Federal, State, City and other local laws, regulations and ordinances;
- (viii) To maintain, at all times, sufficient food, supplies and personnel to operate the Restaurant at maximum capacity and efficiency;

According to the 2025 Bananas Smoothies Frozen Yogurt FDD, to maintain the restaurant's operation from opening day through the term's expiration, a franchisee must adhere to several key requirements. The franchisee must operate the restaurant exclusively as a Bananas Smoothies Frozen Yogurt location under the brand's marks and in strict accordance with the Confidential Operations & Training Manual. No other type of business can be conducted at the franchised location.
Furthermore, the franchisee is obligated to sell all food, menu items, and other products mandated by Bananas Smoothies Frozen Yogurt and is prohibited from selling any unauthorized items. The restaurant must be equipped, maintained, staffed, and operated following the methods and procedures outlined in the Confidential Operations & Training Manual. The franchisee must also actively promote the business using the advertising and promotional materials prescribed by Bananas Smoothies Frozen Yogurt.
To ensure consistent service and quality, the franchisee must keep the restaurant open for business the minimum number of days and hours specified by Bananas Smoothies Frozen Yogurt or as required by the lease. The restaurant's cleanliness and appearance must be maintained in an orderly manner, consistent with the Confidential Operations & Training Manual and the franchisor's directives. Compliance with all applicable federal, state, city, and local laws, regulations, and ordinances is mandatory. Finally, the franchisee must maintain sufficient food, supplies, and personnel to operate the restaurant at maximum capacity and efficiency.
