5.6 POS System, Merchant Service, Computers and Telecommunications.
- a. Franchisee shall purchase or lease for use in the operation of the Bambū shoppe an electronic cash register system, including hardware and software to service the Bambu loyalty rewards program, inventory, and timekeeping applications ("POS System") that meets Bambu's specifications and from a supplier designated by Bambu. Franchisee shall acquire and equip the Bambū shoppe with such other computers, equipment and applications as designated by Bambu from time to time. Such equipment may include hardware, software and possible online subscription applications. Bambu reserves the right to independently access sales and other information about the performance of the Bambū shoppe through the POS System or through any other computer or online system of Franchisee, without restriction. Franchisee is also required to own and use a mobile smart phone or other device agreed to in writing by Bambu that meets Bambu's standards and specifications, with a minimum of 1 GB of combined data plan, that can and will be kept on and used to receive and send communications via SMS, as defined in Section 8.4. Franchisee shall be responsible for all ongoing license, support, maintenance and updates to facilitate operation of the POS System and any required applications.
- b. Franchisee, at Franchisee's sole cost, shall acquire high-speed Internet service that meets Bambu's then current standards to effectively operate its POS System at the Franchised Location. Franchisee's Internet service shall also include in-shoppe customer Internet accessibility. At any time on 90 days' notice, Bambu may require Franchisee to purchase different or additional services, hardware, software, and applications, including but not limited to a different POS System, that meets Bambu's minimum specifications, and may also require that Franchisee pay any related subscription fees. Franchisee's participation and communications on the Internet and on the FRC Materials site will be governed by the standards, specifications and guidelines periodically established by Bambu.
- c. In Bambu's sole discretion, Bambu may provide Franchisee with a social media use policies for posting to approved social media sites and applications, such as Bambū shoppe's Yelp and Google pages. Franchisee may be required to use the social media platform to respond to comments on Yelp and Google and to provide information on views of social media postings. Bambu may change the social media use policies or discontinue them in Bambu's sole discretion.
- 5.7 Permits and Licenses. Franchisee agrees to obtain all permits and certifications as may be required for the lawful construction and operation of the Bambū shoppe, together with all certifications from government authorities having jurisdiction over the site that all requirements for construction and operation have been met, including without limitation, zoning, access, sign, health, safety requirements, building and
other required construction permits, licenses to do business and fictitious name registrations, sales tax permits, health and sanitation permits and ratings and fire clearances.
5.8 Commencement of Operations. Unless otherwise agreed to in writing by Bambu and Franchisee, Franchisee shall, within one year from the date of this Agreement: (1) secure all necessary financing for the shoppe; (2) select, purchase or lease and build-out the Franchised Location; (3) obtain and provide evidence of insurance as described in Article 22 below;

According to Bambu's 2025 Franchise Disclosure Document, franchisees must purchase or lease a Point of Sale (POS) system that meets Bambu's specifications from a designated supplier. This system includes the hardware and software necessary to manage the Bambu loyalty rewards program, inventory, and timekeeping applications. Bambu retains the right to independently access sales and performance data from the franchisee's POS system or any other computer or online system without any restrictions.
Franchisees are also required to have high-speed internet service that meets Bambu's standards to effectively operate the POS system, including providing in-store customer internet access. Bambu can mandate the purchase of different or additional services, hardware, software, or even a different POS system, provided they give 90 days' notice. Franchisees are responsible for all ongoing license, support, maintenance, and updates necessary for the POS system and any required applications.
Furthermore, franchisees must use Bambu's designated POS system and credit card merchant service provider to accept credit and debit cards for all transactions. Compliance with the Payment Card Industry Data Security Standard (PCI DSS) is mandatory to protect cardholder information. Franchisees must adhere to the current PCI DSS standards throughout the term of the agreement, ensuring their Bambu shop is compliant at all times.
Bambu will make available to Franchisee standards and specifications for the POS System. Franchisee must operate the Bambu shoppe in compliance with the mandatory standards and specifications contained in the FRC Materials, as modified by Bambu. Bambu reserves the right to change these standards and specifications with 10 days prior written notice to the Franchisee.
