What This Means (2025 FDD)
According to Bambu's 2025 Franchise Disclosure Document, franchisees are generally restricted to using only the "BAMBŪ®" service mark. However, Bambu retains the discretion to specify other marks that franchisees may use in the identification, marketing, promotion, or operation of their Bambu shoppes. This means that while the primary branding is centered around the "BAMBŪ®" mark, there is a possibility for Bambu to introduce or allow the use of additional service marks at their discretion.
This provision allows Bambu some flexibility in branding and marketing. For example, Bambu could introduce limited-time promotional marks or marks for specific products or services offered at the shoppes. Franchisees must stay informed of any such marks authorized by Bambu, as they are restricted from independently using other marks.
It is important for prospective franchisees to understand that they cannot unilaterally decide to use any service mark other than "BAMBŪ®" without explicit permission from Bambu. Any unauthorized use of marks could be a breach of the franchise agreement. Franchisees should seek clarification from Bambu regarding the process for requesting approval to use alternative service marks, if desired, and under what circumstances such requests might be considered.
