According to the 2025 Bambu Franchise Disclosure Document, the use of Marks is covered in multiple sections. Specifically, under Exhibit C, the Nondisclosure and Noncompetition Agreement, Bambu franchises the operation of shoppes under its trade name and service mark "Bambū® " and other related service marks, logos, commercial symbols, trade names and trademarks (collectively, "Marks").

Item 23 also discusses Marks, stating that upon ceasing to be a franchisee, the franchisee must cease using Bambu's trade secrets, signs, symbols, devices, trade names, trademarks or other materials. The franchisee must also deliver to Bambu all signs, sign-faces, advertising materials, forms and other materials bearing any of the Marks. Additionally, the franchisee must take action to cancel all fictitious or assumed names relating to its use of any Marks under the exclusive control of Bambu.

Item 15.2 specifies that no service mark other than "BAMBŪ® " or such other Marks as may be specified by Bambu shall be used in the identification, marketing, promotion or operation of the Bambū shoppe. Furthermore, the franchisee must notify Bambu in writing of any possible infringement or illegal use by others of a trademark the same as or confusingly similar to the Marks. Bambu has the right to determine whether any action will be taken on account of any possible infringement or illegal use and may commence or prosecute such action in Bambu's own name.
