4.1 Initial Franchise Fee. In consideration for the right to develop and operate one Bambū shoppe, Franchisee shall pay to Bambu the initial franchise fee ("Initial Franchise Fee") in the amounts and at the times set forth in Attachment I. Franchisee acknowledges that the entire Initial Franchise Fee represents payment for the initial grant of the rights to use the Marks and Bambū system, and for the initial services provided by Bambu to Franchisee, and that Bambu has earned the Initial Franchise Fee upon execution of this Agreement, and that the fee is under no circumstances refundable to Franchisee, unless otherwise specifically set forth in this Agreement.
