What happens if changes to the construction plans for a Bambu franchise deviate materially from the initial kitchen workflow design and equipment specifications?

Bambu Franchise · 2025 FDD

Answer from 2025 FDD Document

We will assist you in developing a required kitchen workflow design.

We will provide you with specific equipment specifications for use in creating the layout for your shoppe and an interior design guide, typically after you have signed a LOI for your Franchised Location and before you sign the lease.

We will consult with you regarding your construction documents, which must be prepared by our designated architectural firm or another architect you select, and we approve.

We must approve those documents before you submit them for permitting and construction begins, and if any suggested changes to the plans deviate materially from the initial kitchen workflow design and equipment specifications we provide to you.

You are responsible for the cost of any architectural designs and mechanical drawings that you obtain, and for modifying any plans that we may provide to you, and for the cost of construction. (Sections 5.2, 5.3, 5.4, 5.5, 5.6 and 7.1.c of the Franchise Agreement.) See also "Site Selection Assistance," described below in this Item.

What This Means (2025 FDD)

According to Bambu's 2025 Franchise Disclosure Document, Bambu must approve the franchisee's construction documents before they are submitted for permitting and construction. This includes instances where changes to the plans deviate materially from the initial kitchen workflow design and equipment specifications provided by Bambu.

Bambu assists franchisees in developing a required kitchen workflow design and provides specific equipment specifications and an interior design guide after the franchisee has signed a Letter of Intent (LOI) but before signing the lease. The franchisee may use Bambu's designated architectural firm or another architect, subject to Bambu's approval. The franchisee is responsible for the costs of architectural designs, mechanical drawings, and any modifications to the plans, as well as the cost of construction.

This process ensures that the Bambu franchise maintains a consistent brand standard and operational efficiency. It also means that franchisees need to factor in the time and potential costs associated with obtaining Bambu's approval for any construction plan modifications. Prospective franchisees should discuss the typical extent and nature of required modifications with existing franchisees during their due diligence to better understand potential construction costs and timelines.
